Buying a property- Since the 1970’s foreigners have been able to buy properties in Mexico, even costal and borders properties which they can buy through a bank trust with a Mexican financial institution. The foreigner investors also can directly own rural and urban lands inside the country with some restrictions for some specific agricultural regions.
The Bank trust– This form of deed is made trough a Mexican bank and assure the foreign buyers all the rights and privileges of an owner. In 1994 have been voted the law on foreign investments who is allowing this form of deed to take place for a 50 years period and can be renewed at the expiration. This law protects the rights of the foreign investors and assures that the transaction will be legal and free of any burden.
Title insurance – Since 1996, the Stewart Title Guarantee Company agreed on provide a title insurance to our customers, if they wish to have one. The cost of this insurance is approximately 1% of the amount insured. We are seeing in that, a strong statement from one of the biggest title insurance company of the world, providing insurance for Mexican Real estate.
taxes – known as " Prediales", as they never been considered as a source of revenue for the government , property taxes en Puerto Vallarta are very low. The rate is .08% of the value established at the moment of the sale.
The closing process – It takes between 30 to 45 days to complete the closing process. Trough our office and a local Public Notary we are coordinating the permits requests and the processing of the escrows. The buyer is paying for all the acquisition expenses; the seller is paying for any capital gain taxes and real estate rates. It is not necessary for the buyer and the seller, to be present at the closing (signature of deeds) as they could be represented, by the mean of a legal procuration, by their real estate agent, any relative or their bank representative in the case of a bank trust.
Corporate property– Since 1994, a change in the law of foreign investments now allow Mexican corporations to own properties in the restricted areas as long as it is commercial properties, this apply also for corporations owned 100% by foreigners. We need to mention that commercial properties are coming with higher rates for water and electricity and are requiring additional government reports.
Maintenance fees – The maintenance and security costs for the condominiums are managed by the “association of condominiums owners”. The fees are paid on a monthly basis. The owners who are away from their residence for a certain amount of time should consider hiring a property administration company; we can help you to find one.
Insurance – A lot of different type of insurances are available in Mexico, at a low cost. This includes property, obligation, damages and heart quakes. You can choose within many types of policies and these could be paid in US dollars.
Financing – The real estate investments are not anymore cash money transactions, reserved to owners with large financial capacity. Recently, loan companies with head offices in United-States, like Irwin Mortgage and Metrocity Corporation, started to offer long-term mortgage
financing in Us dollars, for up to 80% of the property value.
Rental potential – There is a very strong market for houses and condo rental in Puerto Vallarta, and we can help you to rent your property if it is what you wish and also to find all the services you could require to do so. The good properties can average up to 85% occupancy.
